Terms of Service

Article 1 (Purpose)
These Terms govern the rights, obligations and responsibilities between KEMI (the "Company") and users regarding the hardware development services and goods provided by the Company, including PCB artwork design, PCB fabrication, component sourcing and SMT assembly, and 3D printing (the "Services").
Article 2 (Definitions)
- "User" means an individual or entity that requests a quotation or uses the Services through the Company's website.
- "Request" means the act of submitting materials such as schematics, Gerber files, BOM or 3D model files to ask the Company to perform the Services.
- "Deliverable" means design data, printed circuit boards, assembled boards, printed parts and similar items delivered to the User as a result of the Services.
Article 3 (Effect and Amendment of Terms)
These Terms take effect upon publication on the website.
The Company may amend these Terms within the scope permitted by applicable law. Amendments are announced on the website at least 7 days before the effective date, stating the effective date and reason. Amendments unfavourable to Users are announced at least 30 days in advance.
Article 4 (Scope of Services)
The Company provides the following Services.
- PCB Artwork: printed circuit board layout design based on the User's schematic, and delivery of fabrication data
- PCB Fabrication: manufacture and delivery of printed circuit boards from Gerber data
- Parts & SMT: component sourcing based on a BOM, surface-mount assembly and related assembly work
- 3D Printing: prototype enclosures, cases and jigs produced by FDM or SLA processes
- Circuit and RF debugging and technical support incidental to the above
Article 5 (Formation of Contract)
A contract is formed when the Company provides a quotation in response to the User's Request and the User accepts it by placing an order. For standard products sold at a listed price on the website, the contract is formed when the User's order and payment are completed.
The Company may decline a Request or terminate a contract in the following cases.
- Where the submitted materials infringe a third party's intellectual property rights or are likely to be used for unlawful purposes
- Where the submitted materials are incomplete such that manufacturing is impossible and the User does not respond to the Company's request for supplementation
- Where the required specifications cannot be met with the Company's facilities or technology
Article 6 (Payment)
Fees are based on the amount stated in the quotation or on the product page. Whether VAT is included is specified in the quotation.
Bank transfer is the standard payment method; any other method the Company makes available is stated in the quotation.
For made-to-order work, all or part of the fee is generally payable in advance; specific terms are set out in the quotation.
Article 7 (Delivery Schedule)
Lead times follow the period stated in the quotation, counted from the later of the date the materials are finalised and the date payment is made.
Delivery may be delayed due to circumstances beyond the Company's control, such as manufacturer scheduling, component supply shortages or force majeure. In such cases the Company will notify the User without delay and consult on the matter.
Article 8 (Withdrawal, Cancellation and Refunds)
For standard products sold on the website, Users may withdraw their order within 7 days of receipt. However, under Article 17(2) of the Act on Consumer Protection in Electronic Commerce, withdrawal may be restricted for goods produced individually to the User's order where allowing withdrawal would cause irreparable damage to the Company. In such cases the Company gives clear notice before the order is placed.
Cancellation of made-to-order work is handled according to the stage of progress.
- Before commencement: full refund of amounts paid
- During design or after ordering from suppliers: refund of the balance after deducting costs corresponding to work performed
- After manufacturing is complete: refunds are generally not available where cancellation is attributable to the User
If a Deliverable is defective due to a cause attributable to the Company, the User may notify the Company within 14 days of receipt, and the Company will remake the item free of charge or refund the fee, as agreed with the User.
Refunds are made in principle to the original payment method within 3 business days after the Company confirms the grounds for refund.
Article 9 (Intellectual Property and Handling of Materials)
All rights in materials submitted by the User, including schematics, Gerber data and 3D models, remain with the User.
The Company uses submitted materials solely to perform the relevant Request and does not disclose or provide them to third parties without the User's prior consent, except to subcontractors to the extent necessary to perform manufacturing or assembly.
Rights in design methodologies, libraries and know-how independently developed by the Company remain with the Company.
The Company may use part of a Deliverable in its portfolio only with the User's prior written consent.
Article 10 (User Obligations)
- The User must provide accurate materials and specifications; the User is responsible for outcomes caused by errors in the materials provided.
- The User must not submit materials that infringe third-party intellectual property rights.
- The User must not use the Services for purposes restricted under applicable law, including military applications.
Article 11 (Limitation of Liability)
The Company is not liable for damages arising from errors in materials provided by the User, changes to specifications requested by the User, or force majeure.
Absent wilful misconduct or gross negligence, the Company's liability is limited to the fee for the relevant order.
Article 12 (Governing Law and Disputes)
The Company and the User shall endeavour to resolve any dispute arising under these Terms through mutual consultation.
If no agreement is reached, these Terms are governed by the laws of the Republic of Korea and disputes are submitted to the competent court under the Korean Civil Procedure Act.
These Terms take effect on 19 July 2026.
